Article 2 - DEFINITIONS

« General Terms and Conditions of Use » hereinafter referred to as the « GTCs » define and govern the terms and conditions for browsing the Site for members connected to their PRIVATE SPORT SHOP Club account and determine the respective rights and obligations of the Members and of PRIVATE SPORT SHOP in the context of the use of the Site. They allow the Member to be informed about the content of the Site, as well as the scope of the Services offered.

« Personal Data » defines any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

« Member(s) » defines any internet user declared as being at least 16 years old and having given any Personal Data concerning themselves on the registration form and using the Site Services after receiving a confirmation email.

« Services » define the services provided by PRIVATE SPORT SHOP on its Site.

« Site » defines the website of the company PRIVATE SPORT SHOP, accessible at the address https://www.privatesportshop.com/en and on its mobile app.


Article 3 - Scope and acceptance of the GTCs of the Site

These GTCs are in English and are intended to apply exclusively between PRIVATE SPORT SHOP and any Member wishing to access the Site and use the Services. PRIVATE SPORT SHOP is a private club specialised in the sale of sports items to its Members only (hereinafter referred to as the « Club »)

The Services are solely reserved for Members. Any use of the Services by the Member automatically implies the application of the present GTCs as well as the PRIVATE SPORT SHOP Privacy Policy.

The Member undertakes to provide accurate personal contact information as well as any other information required to access the Site's Services and to update this information regularly.


Article 4 - Registration and access to the Site and Services

Services are available to Members from the Site. In becoming a Member, you are a part of PRIVATE SPORT SHOP's Club. As such, you will have access to all of our Services, that include in particular:

  • Receiving exclusive news and content on the world of sport and outdoor activities several times a week in partnership with WeRockSport.com
  • Becoming a tester of new products from leading sports and outdoor brands and contribute to the research and development of PRIVATE SPORT SHOP partner brands
  • Becoming a SportAdvisor and being paid to help other PRIVATE SPORT SHOP members and guide them in their choice of sports and outdoor equipment
  • Becoming a PRIVATE SPORT SHOP ambassador on social media
  • Being informed of upcoming sales at PRIVATE SPORT SHOP
  • Receiving exclusive promo codes reserved for PRIVATE SPORT SHOP members
  • Participating in competitions, anonymous studies, product questionnaires in order to understand the behaviour of users, customer preferences, customer buying/sports habits

Unless otherwise expressly stated, any enhancement of one or more existing Services or any new Service launched by PRIVATE SPORT SHOP shall be subject to this Agreement.

A Member can only create one account. The creation of multiple accounts by the same Member could lead to the suspension or the termination of all or some of the Member's different accounts.

To sign up and become a Member of the Club via the Site https://www.privatesportshop.com/en, the internet user can sign up here:

  • Either directly on the Site by filling in the registration form,
  • Or by a prior referral from a PRIVATE SPORT SHOP Member. The referred person then receives an invitation e-mail to become a Member containing a redirection URL to the Site. By clicking on the redirection URL, the referred person will be redirected to the Site and will then have to sign up to become a PRIVATE SPORT SHOP Member.

In both cases, the signed up member will then have access to a private space as well as all of the Site's content and Services.

Once their inscription is confirmed on the website, PRIVATE SPORT SHOP will send an email to the Member to confirm their registration on the Site.


Article 5 - Member Obligations

The Member undertakes to use the Site in a way that:

  • Respects the provisions of the GTCs
  • Respects all legislative and regulatory provisions, public order, good morals (the "Law") and the rights of third parties (including intellectual property or contractual rights, image rights and privacy rights)
  • Not to make any statements (or disseminate any content) that are derogatory, defamatory, pornographic, obscene, racist, offensive, xenophobic or that damage the image or reputation of a brand or a person

Article 6 - Description of the Referral Service

When registration on the Site has been carried out by prior referral, the referrer is informed of the fact that any referral is limited to a restricted network (relatives, friends) of the actual acquaintance of the referrer.

Consequently, the massive recruitment of referrals outside of this framework, for direct or indirect lucrative purposes, or even free of charge, by any means such as, in particular, via an Internet site, a blog, Internet advertisements, magazines or discussion forums is strictly prohibited.

If PRIVATE SPORT SHOP becomes aware of serious irregularities by a Member in the use of its Referral Service, it may take any appropriate action to stop such irregularities, including the suspension or termination of the Member's account.


Article 7 - Description of the My Account Service

All Members who have access to the My Account Service can:

  • consult, modify, complete their details, their profile, their payment methods, their password and their delivery addresses
  • consult the list of received refunds after cancelled orders.
  • check the history of their previous orders made on the Site, find out the order status of these orders
  • consult their referral history, as well as the vouchers and credits available to them.

Article 8 - Description of the Referrals and Vouchers, Communications and Favourites Services

Referrals and Vouchers

Members can invite their friends and get vouchers. To invite their friends, they can go to « Referrals », enter a list of contacts manually or by using their address books and send an invitation.

When one of the contacts accepts the invitation, they become a referee. When you refer a friend, you can get a €10 voucher each time one of your referees makes their first purchase of a minimum of €20 on https://www.privatesportshop.com/en.

The Member will receive an email for each voucher earned. The €10 voucher will be credited to the Member's account as soon as the referred person has made their first purchase, and after the 14-day post-delivery retraction period has passed.

Vouchers are valid for 1 year following their date of creation.

Communications, Favourites

Members can receive emails from PRIVATE SPORT SHOP to inform them of the Site's news, to invite them to discover its sales events or alert them of the preparation of future sales of their favourite brands or product categories that they have previously selected.

Members can manage their subscriptions to these emails as well as alerts by freely and specifically choosing those they wish to receive, or not.

Members can consult and modify their alerts at any time on the « Favourites » page.


Article 9 - Warranties & Liability

PRIVATE SPORT SHOP does its best to make its Site available 24 hours a day, 7 days a week, regardless of scheduled maintenance operations, subject to the provisions of this article.

PRIVATE SPORT SHOP makes no warranties, express or implied, including, but not limited to, warranties as to the quality and suitability of the Services for a specific purpose, unexpected interruptions or bugs or viruses in the Site, and non-violation of the rules of use of the Services by its Members.

The Member declares that they accept the characteristics and limits of the Internet, and in particular acknowledges that the Site is accessible to them "as is" and according to its availability, that the protection of their own content is their responsibility and that it is up to them to take all appropriate measures in order to protect themselves from possible viruses.

The Member must keep their details and password strictly to themselves. They must not in any case communicate their details to a third party to allow them to access the Site.

PRIVATE SPORT SHOP undertakes to do its best to ensure the operation of its Site in the best conditions.

PRIVATE SPORT SHOP declines all responsibility towards the Member for any interruption, suspension or malfunction of the Site, loss of data, occurrence of bugs, or any damage resulting from fraudulent intrusion by a third party leading to a modification of the information made available on the Site.

In any case, PRIVATE SPORT SHOP shall not be liable in case of non-conforming use of the Site by a Member. The Member acknowledges that they are solely responsible for the use made by them of the Site from their account and for the consequences of this use.


Article 10 - Suspension - Termination of Site access

PRIVATE SPORT SHOP reserves the right to suspend or refuse access to the Site to any Member who does not respect the terms of these GTCs.

In this instance, PRIVATE SPORT SHOP will send a notification to the Member to stop them acting or behaving against these GTCs. In the absence of a response within the given timeframe, PRIVATE SPORT SHOP reserves the right to terminate the Member's account.


Article 11 - Personal Data

PRIVATE SPORT SHOP is the data controller of your personal data.

Article 12 - Modifications of the GTCs

PRIVATE SPORTS SHOP reserves the right to freely modify the GTCs. Any new version of these will be posted on our website and will include the date of publication.

Consequently, we invite you to refer to them each time you visit in order to be aware of their latest version, which is permanently available online on the Site. You are therefore free to not access the Services if the conditions no longer suit you.

Members who do not wish their contractual relationship to be governed by the new version of the GTCs must make this known and, from the date on which the new version takes effect, they must cease using the Services.

Any modification will come into effect immediately and will only apply to Members using the Services after said modification.


Article 13 - Applicable law and jurisdiction

THESE GTCs ARE SUBJECT TO FRENCH LAW. IN THE EVENT OF A DISPUTE RELATING TO THE INTERPRETATION, VALIDITY AND CONSEQUENCES OF THESE GTCs AND, IN THE ABSENCE OF A PRIOR AMICABLE SOLUTION, THE COURTS OF MONTPELLIER SHALL HAVE SOLE JURISDICTION.
